Terms of Use

These Terms of Use ("Terms") govern your use of the FaceMax AI: Glow Up Lab mobile application (the "App"), operated by FaceMax AI ("we," "our," or "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.

2. Eligibility

You must be at least 18 years old to use the App. By downloading or using the App, you confirm that you are 18 years of age or older. If you are under 18, you are not permitted to use the App.

3. App Store Terms

The App is distributed via the Apple App Store. Your use of the App is also subject to Apple's Standard End User License Agreement (EULA). In the event of any conflict between these Terms and Apple's EULA, Apple's EULA governs with respect to the licence grant only. Apple is not a party to these Terms and bears no responsibility for the App or its content.

4. Subscriptions and Payments

• Premium Plans: Certain features require a paid subscription (weekly, monthly, or yearly). Prices are displayed in the App before purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged upon confirmation and at the start of each renewal period.
• Cancellation: You may cancel at any time via iPhone Settings → Apple ID → Subscriptions. Access continues until the end of the paid period.
• Free Trials: If a free trial is offered, any unused portion is forfeited when a paid subscription begins.
• Refunds: All billing is handled by Apple. Refund requests must be submitted directly to Apple.

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation.
• Upload content that is unlawful, harmful, or infringes third-party rights.
• Attempt to gain unauthorised access to our systems or interfere with the App's operation.
• Use the App for any commercial purpose without our prior written consent.

6. AI-Generated Content and Accuracy

The App uses artificial intelligence to generate facial analysis reports, grooming recommendations, and nutritional insights. This content is for informational and entertainment purposes only. It does not constitute medical, dermatological, dietary, or professional advice. We make no guarantees regarding the accuracy, completeness, or fitness of AI-generated results for any particular purpose. Always consult a qualified professional for health or medical decisions.

7. Intellectual Property

All content within the App — including but not limited to text, graphics, logos, icons, and software — is owned by or licensed to us and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in that policy.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, the license granted to you will immediately cease.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date above. Continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kyrgyz Republic, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the Kyrgyz Republic.
